Platform: Pitcha Web Network & Pitcha App • Effective Date: October 10, 2026
1. Acceptance of Terms
By accessing, browsing, downloading, or using the Pitcha web platform or the official Pitcha App, you (“User” or “You”) enter into a legally binding agreement governed by these Terms of Service. If you do not agree to these terms in their entirety, you must immediately discontinue use of the Platform and uninstall the Pitcha App.
2. Service Scope & Availability
- Media Streaming & Downloads: Pitcha provides an open catalogue of streaming and downloadable movies, long-form videos, and documentaries across compatible web browsers and the native Pitcha App.
- Interactive Gaming Services: Pitcha hosts online and downloadable casual video games intended for browser-based real-time play and offline device execution.
- Cost Structure: Access to core platform features, media streaming, downloads, and game files is free of charge. Platform hosting and bandwidth are sustained through integrated digital advertisements and voluntary user donations.
- Service Modifications: Pitcha reserves the right to modify, suspend, update, or discontinue any feature, video stream, download repository, game title, or application service at any time without prior notice or liability.
3. User Accounts & Access Tiers
Guest Access: Users may freely browse public video catalogues, stream content, download open files, and play games without provisioning an account.
Registered Accounts: Registering an account is required to upload content, leave comments, participate in community discussions, track playback libraries, or synchronize game progression across hardware. You are solely responsible for safeguarding your login credentials and for all actions taken under your account.
4. User-Submitted Media & Uploads
Submission Responsibility: Registered users may submit, upload, and publish video files, metadata, descriptions, and media posters. Pitcha operates solely as a passive technical hosting provider. You bear exclusive legal, technical, and regulatory responsibility for all files, media, and materials you transmit, store, or display through Pitcha.
No Platform Verification Guarantee
Pitcha does not inspect, verify, authenticate, monitor, warrant, or guarantee the origin, ownership, licensing, legality, authenticity, or rights status of any user-submitted files. Pitcha expressly disclaims all responsibility and liability for the nature and legality of user submissions.
No Remuneration: Pitcha does not currently offer monetary payments, royalties, or creator compensation for uploaded media. Pitcha reserves the explicit right, at its sole discretion, to introduce monetization, revenue-sharing, or creator compensation schemes in the future under separate written terms.
Platform License: By submitting content, you grant Pitcha a worldwide, royalty-free, non-exclusive license to host, transcode, store, stream, distribute, and display such media across our platform, mobile infrastructure, and the Pitcha App.
Takedown & Removal: Pitcha reserves the unrestricted right to remove, block, or delete any uploaded material at any time, for any reason or no reason, without liability or explanation.
5. Pitcha Gaming Arena
- Recreational Purpose: All online and downloadable games provided via Pitcha are intended exclusively for casual recreation and skill-based entertainment.
- Absolute Zero-Cash Value: In-game tokens, grades, scores, levels, items, or virtual unlocks hold zero monetary value and cannot be redeemed, traded, or withdrawn for fiat currency, cryptocurrency, or physical items.
- Fair Play Principles: Users agree not to modify game binaries, inject code, utilize unauthorized emulation tools, exploit network protocols, or artificially alter scores or leaderboards.
6. Advertisements & Voluntary Donations
Advertising Ingestion: To maintain free access, Pitcha serves third-party advertisements within the web platform, the Pitcha App, video players, and gaming components. We make no representations regarding third-party advertisers or the goods/services they promote.
Voluntary Donations: Users may voluntarily submit financial contributions or donations to support hosting and server infrastructure. Donations are non-refundable, non-transferable, and confer no ownership, equity, governance, or administrative rights in Pitcha.
7. Prohibited Conduct
When using the Pitcha platform or Pitcha App, you agree not to:
- Interfere with, circumvent, probe, or breach the security, authentication, or infrastructure of our servers, CDNs, or networks.
- Automate access, scrape video streams, reverse-engineer the Pitcha App, or harvest platform data via unauthorized scripts, bots, or spiders.
- Upload content containing malware, worms, trojans, ransomware, or malicious exploits.
- Transmit abusive, predatory, defamatory, harassing, or unlawfully graphic materials.
- Violate any applicable local, national, or international statute or regulation.
8. Disclaimers & Limitation of Liability
“As-Is” Provision: Pitcha, the Pitcha App, streaming delivery, video downloads, and gaming packages are provided strictly on an “AS IS” and “AS AVAILABLE” basis. We disclaim all warranties, whether express, statutory, or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, server uptime, or download speed.
Liability Cap: Under no circumstances shall Pitcha, its founders, operators, or affiliates be liable for indirect, incidental, punitive, or consequential damages resulting from user uploads, data loss, interruption of service, app malfunctions, device errors, or third-party links.
9. Account Suspension & Termination
Pitcha reserves the right to suspend, freeze, or permanently delete any user account and block network addresses from the Platform or Pitcha App without notice if a user breaches these Terms or engages in behavior deemed detrimental to the Platform.
